Booking Policy

This Booking Policy outlines the terms under which the school engages with Impact Travel Group Pty Ltd (t/a Impact Adventures), ABN 20 666 721 802, ACN 666 721 802.

BOOKINGS

Payment Schedule

Unless otherwise stated, payment will be divided into four (4) instalments, with the schedule outlined in the quote we send you.

Price and Booking Confirmation

All charges are in Australian dollars and may change before we accept your deposit or if the number of students is reduced. Prices are based on the quoted itinerary, with inclusions and exclusions outlined in the quotation.

We will issue a receipt for each payment we receive, with the payment of the deposit marking the establishment of a contract between the school and Impact Adventures.

Cooling Off Period

Impact Travel Group offers a cooling-off period of 7 days for refunds on deposit made by students for their participation in the program. During this period, students may cancel their booking and receive a full refund of any payments made, excluding processing and service fees of 3.5% from the original booking price, provided they us in writing within 7 days of the booking confirmation. This cooling-off period allows students to change their minds about the booking for any reason.

Services

Working together with the school, we will render the following services under our engagement with you:

• Arranging and coordinating travel plans.

• Assisting with risk assessment and emergency management plan.

• Organising and coordinating the delivery of the travel arrangements.

Fixed Price Model and Implications

In collaboration with our partners, we introduce a Fixed Price model for our program to mitigate fluctuation in flight prices and uncertain exchange rates. By agreeing to participate in the program under the Fixed Price Model, the school acknowledge and consents to the following conditions:

• No Alteration of Itinerary

You acknowledge that any modifications to the itinerary may impact the pricing that was established before the bookings.

• Maintenance of Student Numbers

For the Fixed Price travel model to remain in effect, the number of students stipulated in the quotation must be attained and sustained until the travel date. Changes in the number of students may affect the price, necessitating corresponding adjustments.

• Non-Refundable Payments under the Fixed Price Travel Model

Under the Fixed Price Travel model, prices are determined based on assumptions about the group's student count. To maintain the originally set price, all payments, through payment plans, are non-refundable.

• Obligation to Pay the Entire Outstanding Amount

In the event of a withdrawal, the obligation to pay the entire outstanding amount remains unchanged unless the withdrawal occurs before the due date of the second instalment.

To clarify, if a withdrawal occurs after the deposit or first instalment has been paid but before the due date of the third instalment, the student is not required to pay the entire outstanding amount. However, it's important to note that all payments made are non-refundable without exception.

• Force Majeure Provisions

In circumstances where force majeure events lead to the cancellation of the entire travel plans for the entire group, we will provide a travel credit for the group's utilisation within one year from the booking date. For a complete refund, it is recommended to obtain travel insurance that may offer full compensation for travel cancellations due to force majeure events.

MEDICAL

Collaborating with you, we will address low-risk medical requirements within the group with our in-house doctor and nurse. Additionally, we have identified and have access to several major hospitals for emergency medical treatment. We also have a ready ambulance available in the main port for parts of the trip that may pose higher risks, such as snorkelling or boat trips.

RISK MANAGEMENT

Working with the school, we will create a risk management plan that is implementable on the ground and acceptable to both the school and or the Department of Education.

NON-COMPETING

As each itinerary is unique and relies on our intellectual property and networks, the school must clearly state its intentions before requesting a quote for price bidding purposes.

By accepting our quote, the school agrees not to solicit pricing details for the provided itinerary from other tour providers, directly contact the local guides or service providers introduced by us or disclose and share these contacts or itineraries with other tour providers. This agreement helps to prevent any competition that would otherwise rely on our intellectual property and established networks.

PRIVACY POLICY

1. Collection and Use of Personal Information:

a. Consent: By engaging in this School Group Tour, you consent to the collection, processing, and utilisation of personal information as required for the administration, coordination, and facilitation of the tour program.

b. Types of Information: Personal information may include but is not limited to student names, ages, medical information, dietary preferences, emergency contact details, and any other pertinent information required for the successful execution of the tour.

c. Purpose: The collected personal information is solely used for the organisation and facilitation of the tour program, ensuring student safety, medical care if required, and effective communication between tour organisers, school representatives, and participants.

2. Information Disclosure:

a. Sharing Information: Personal information will be disclosed only to those individuals directly involved in the tour organisation, such as tour organiser, airlines, boat operator, accompanying teachers, medical personnel, local guides, and relevant authorities if necessary for safety or regulatory reasons.

b. Third-Party Sharing: Under no circumstances will personal information be shared with unrelated third parties for commercial or marketing purposes.

3. Security and Retention:

a. Security Measures: Reasonable and appropriate measures will be taken to safeguard the collected personal information against unauthorised access, disclosure, or alteration.

b. Data Retention: Personal information will be retained only for the duration necessary to fulfill the purposes outlined in this Privacy Policy or as required by law.

4. Rights and Choices:

a. Access and Correction: Participants have the right to access their personal information collected for the tour program and request corrections or updates if necessary.

b. Withdrawal of Consent: Participants have the right to withdraw consent for the use of their personal information, subject to legal or contractual restrictions and reasonable notice.

GOVERNING LAW AND DISPUTE RESOLUTIONS

This Booking Policy is governed by, and must be construed in accordance with, the laws of Victoria. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the Victorian courts. By submitting a booking request, the school is deemed to have accepted and agreed to all terms in these Booking Conditions, including any terms that may be added or amended later.
